The Hotel Hostal del Sol (Gomagon SLU), with tax address at Carretera de Palamós, 194 de Sant Feliu de Guíxols and with CIF B58534769 organizes this campaign called Instagram Contest #HolidaysHHSOL

OBJECTIVE: The #HOLIDAYSHHSOL photo competition consists of publishing photographs and videos about how the holidays are lived on the Costa Brava and at the Hotel Hostal del Sol with the hashtag #HOLIDAYSHHSOL on the Instagram network. The images must be taken on the Costa Brava (it is not necessary at the hotel, but the jury will take into account the proximity to our facilities) If you do not follow us on Instagram, the photographs/videos will not be valid.

DEADLINE: The competition will start on April 1, 2024 and end on October 12, 2024.

FORM OF PARTICIPATION: To participate in the contest, you must have an Instagram account with a public profile and respect the conditions of this network (http://instagram.com/legal/terms/).

Participants must:

- Take a photograph or video related to the atmosphere of the Costa Brava during your stay at the hotel.

- Tag the photograph/video with the hashtag #HOLIDAYSHHSOL. There is no limit to the number of photos/videos per participant.

- Mention and become a follower of the establishment's account: @hotel_hostal_del_sol

  CHARACTERISTICS OF THE IMAGES: Participants, by participating, declare under their responsibility that the images do not contain any obscene, sexually explicit, violent, offensive, incendiary or defamatory content or material. Also that they have obtained the authorizations of the people and entities that may appear there. The organization reserves the right to reject photographs and messages that do not comply with the above characteristics as well as those that are discriminatory by reason of birth, race, sex, religion, opinion or any other personal or social condition or circumstance.

AWARDS:

-At the end of the season, the jury will choose a winning photo/video that we will publish on our own profile, and of which the user will be asked for the original file. As a prize, you will receive a promotional code for the equivalent of two hotel nights for two people with breakfast included at the Hotel Hostal del Sol in Sant Feliu de Guíxols for the 2025 season which can be redeemed exclusively on the website www. hostaldelsol.cat

Gomagon SLU is not responsible for possible losses, deterioration, theft or any other circumstance attributable to the courier services that may affect the delivery of the prizes.

Protection of personal information:

The data provided by the participants will be treated confidentially and collected in an automated file of personal data, the company GOMAGON, SLU being the owner and responsible for this file, with the aim of:

Manage the participation of contestants and get in touch with them.

Communicate that there have been winners of the competition

Send commercial information about the accommodations managed by the company GOMAGON, SLU

Gomagon SLU guarantees full compliance with Organic Law 15/1999, of December 13 on the Protection of Personal Data in the treatment of personal data collected during the Instagram #HolidaysHHSOL competition, especially in what refers to the attention to the exercise of the rights of information, access, rectification, opposition and cancellation of contestants' personal data.

Penalties in case of fraudulent use:

We will understand as fraud the use of independent platforms or applications to obtain votes or more participation in the contest, in the same way as behaviors that we detect as apparently abusive and/or malicious.

The finding of any of these practices will result in the disqualification of the competition.

GOMAGON, SLU reserves the right to take legal action against those who carry out any type of act likely to be considered manipulation or falsification of the contest.

GOMAGON, SLU is exempt from any responsibility for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which you participate in the promotion, to the fraud of the utility that the users may have attribute to the same and to access to the different pages and submissions of participation responses via the internet.

Assignment of image rights and/or intellectual property:

The photographs or videos with which you participate must be unpublished, that is to say, they have not been previously disclosed. If the photograph has been displayed on the internet (for example, on a social network), or in any other way, it will no longer be unpublished. Therefore, this requirement will be breached.

Participants and winners will assign the rights of exploitation, reproduction, transformation and public communication of their photographs/videos to the company GOMAGON, SLU for the Instagram contest #HolidaysHHSOL for a period
